ALL JOB ORDERS REQUIRE A 100% ADVANCED PAYMENT
DUE IMMEDIATELY UPON PLACING AN ORDER. IT IS THE POLICY OF SPUNWELL
BUSINESS SOLUTIONS LLC. THAT SUCH ADVANCED PAYMENTS ARE STRICTLY
NON-REFUNDABLE.
CUSTOMER REPRESENTATION / PRINT CONTENT
BY SENDING SPECIFICATIONS, IMAGES OR FILES TO
SPUNWELL BUSINESS SOLUTIONS LLC. CLIENT REPRESENTS THAT CLIENT
IS THE SOLE AUTHOR OF THE WORK AND POSSESSES ALL RIGHTS TO USE
SUCH SPECIFICATIONS, IMAGES OR FILES, INCLUDING BUT NOT LIMITED
TO ANY EXCLUSIVE LICENSES. CLIENT FURTHER REPRESENTS THAT THE
SPECIFICATIONS, IMAGES OR FILES DO NOT INFRINGE UPON ANY STATUTORY
COPYRIGHT, COMMON LAW RIGHT, TRADEMARK, LICENSE OR ANY OTHER
PROPRIETARY RIGHT. IN FURNISHING SUCH SPECIFICATIONS, IMAGES
OR FILES TO SPUNWELL BUSINESS SOLUTIONS LLC., CLIENT AGREES TO
HOLD SPUNWELL BUSINESS SOLUTIONS LLC. HARMLESS AGAINST ANY CLAIMS
WHATSOEVER ASSOCIATED WITH THEIR USE OR EXPLOITATION.
CUSTOMER REPRESENTATION / DISC CONTENT (Audio/Video/Programs)
CUSTOMER WARRANTS THAT: (A) THEY ARE THE OWNER, THE AUTHORIZED
AGENT OF THE OWNER, OR THE LICENSEE OF ALL CONTENTS AND MATERIAL
PROVIDED TO SPUNWELL BUSINESS SOLUTIONS LLC.; (B) THE CUSTOMER
AGREES TO INDEMNIFY, DEFEND, AND HOLD SPUNWELL BUSINESS SOLUTIONS
LLC. HARMLESS AGAINST ANY CLAIMS AND/OR LIABILITY RESULTING FROM
CLAIMS THAT ANY LAW, PATENT, COPYRIGHT, TRADEMARK, TRADE-NAME,
PROPRIETARY RIGHT, OR OTHER RIGHT OF ANY THIRD PARTY HAS BEEN
INFRINGED BY THE MASTERING, DUPLICATION, REPLICATION, DISTRIBUTION,
SALE, RENTAL OR USE OF MATERIAL; (C) THE CUSTOMER ATTESTS THAT
THE MEDIA PRESENTED TO SPUNWELL BUSINESS SOLUTIONS LLC. IS ÒDUPLICATION/REPLICATION
READY,Ó THAT IT CONFORMS TO INDUSTRY STANDARD SPECIFICATIONS,
AND THAT THE CONTENT AND QUALITY OF THE MASTER HAS BEEN REVIEWED
AND APPROVED FOR DUPLICATION AND/OR REPLICATION.
IF DELIVERY
IS IMPAIRED BY AN ACT OF GOD, ELECTRICAL FAILURES, AIRLINE DELAYS
OR CANCELLATIONS, ETC., SPUNWELL BUSINESS SOLUTIONS LLC. WILL
MAKE A REASONABLE ATTEMPT TO COMPLETE THE CUSTOMER'S JOB ORDER,
HOWEVER, CLIENT AGREES NOT TO HOLD SPUNWELL BUSINESS SOLUTIONS
LLC. LIABLE IF DELIVERY IS IMPAIRED OR DELAYED BY ANY SUCH ACT
OF GOD, ELECTRICAL FAILURES, AIRLINE DELAYS OR CANCELLATIONS,
OR ANY OTHER UNFORESEEABLE DELAY IN JOB ORDER COMPLETION (AND
DELIVERY IF APPLICABLE).
DUE TO OUR GANG RUN PRINTING PROCESS OF OUR 14PT CARD STOCK,
THE EXACT COLOR AND EXACT SIZE CUTS WILL NOT BE GUARANTEED.
SPUNWELL Business Solutions LLC's. name and number
(at or below 6 point) will be printed on all flyers designed
and/or printed by our staff. In the event that SPUNWELL Business
Solutions LLC. is not able to tag artwork designed by SPUNWELL
Business Solutions LLC., by clients request, a $125 fee will
be added to your invoice. Some considerations may be applied
for orders not designed by us, however some restrictions apply.
DESIGN PROOFS SENT
BY EMAIL OR FAX
(ONLY IF WE ARE DESIGNING).
THE
PURPOSE OF A PROOF IS TO ELIMINATE ERRORS OR DISSATISFACTION.
YOU ARE REQUIRED TO EMAIL US YOUR APPROVAL. BY APPROVING THE
JOB PROOFS YOU ARE INDICATING THAT YOU ARE RESPONSIBLE FOR ANY
CHARGES TO RE-MAKE OR CHANGE A JOB IN THE EVENT THAT YOU SIGNED
OFF ON A PROOF THAT CONTAINED AN ERROR (YOUR ERROR OR OUR ERROR)
INCLUDING BUT NOT LIMITED TO SPELLING ERRORS. WE ALSO REQUIRE
ADDITIONAL TIME TO RE-MAKE OR MODIFY YOUR JOB ORDER DESIGN AND
THIS WILL AFFECT THE DUE DATE. DESIGN FEE'S ARE NOT REFUNDABLE
ONCE AN ORDER HAS BEEN STARTED BY OUR TEAM.
PLEASE NOTE: SUBMITTING ARTWORK FOR PRINT
By the time your job is received by email, all edits should be finalized, the
copy carefully proofread and all design issues should be settled. We are not
responsible for proofing any submitted jobs and we will not take any responsibility
for any copy or design errors committed on your part after submission of work.The
files should also meet the required "Ready To Print File Specifications" listed
here. Charges for any and all modifications will be added to your invoice.

"RESTRICTIONS"
YOU, THE CLIENT, CANNOT CREATE A "SERVICE MARK" OR "TRADEMARK" USING
IMAGES OF ANY KIND BELONGING TO SPUNWELL BUSINESS SOLUTIONS LLC.
OR ITS LICENSORS.
POLICY ON SHIPPING
SPUNWELL BUSINESS SOLUTIONS LLC. WILL MAKE EVERY NECESSARY ATTEMPT
TO COMPLETE AND SHIP THE CUSTOMER'S JOB ON SCHEDULE. IF A DELIVERY
IS IMPAIRED BY AN ACT OF GOD, ELECTRICAL FAILURES, AIRLINE
DELIVERY DELAYS, ANY TRANSPORTATION DELAY, OR CANCELLATIONS,
OR ANY OTHER DELAY OUT OF SPUNWELL BUSINESS SOLUTIONS LLC.
CONTROL, THEN SPUNWELL BUSINESS SOLUTIONS LLC. WILL ASSIST
THE CLIENT IN LOCATING THE DELIVERY. SPUNWELL BUSINESS SOLUTIONS
LLC. IS NOT RESPONSIBLE FOR ANY BOXES LOST OR DAMAGED BY THE
SHIPPING COMPANY OR COURIER. THE CUSTOMER AGREES NOT TO HOLD
SPUNWELL BUSINESS SOLUTIONS LLC. LIABLE UNDER ANY OF THE ABOVE
CONDITIONS. ABSOLUTELY NO REFUNDS.
ORDERS FOR LOCAL
OFFICE PICK-UP
ALL LOCAL ORDERS WILL BE HELD FOR A PERIOD OF 2 WEEKS MAXIMUM.
IF YOU ORDER IS NOT PICKED UP DURING THIS TIME, WE WILL NOT BE
RESPONSIBLE FOR YOUR BOX IF IT GETS LOST, DAMAGED OR TRASHED.
TO AVOID ANY OF THESE INCIDENTS, WE URGE YOU TO PLEASE PICK UP
YOUR BOX WITHIN A REASONABLE TIME.
CANCELING A JOB OR SERVICE ALREADY IN PROGRESS
PRINT
Due to the nature of the 24 hour turnaround printing, we process
jobs as soon as they are paid. If you need to cancel or replace
any files on an order you have placed, you must email or call and speak
to a Spunwell Business Solutions LLC. Manager no later than
10 minutes after your order is paid. If we can catch the job
before it goes to print, we will be more than happy to attempt
to replace or cancel the order. If the job is already scheduled
for production, you are responsible for full payment when re-making
your order including shipping cost.
GRAPHICS
Due to the nature ofdesign work, once we begin the design process
there is no cancelation of the design work although the print work may be cancelled if no approval has been given for the artwork in question. If you need to cancel, replace or make changes to an order you have placed, you must email or call and speak
to someone at Spunwell Business Solutions LLC. immediately upon needing to have the changes or cancellations made. There will be absolutely no refunds for graphic design work.
Web Hosting
Web hosting is paid in one and two year terms standard. Additional years may be added, however payments are due in advance for all services ordered and are not refundable. If our servers for technical reasons, act of God, or electrical failure, go down we will credit you for the time we are down up to 48 hours at wich time it is expected your site will be back up and running. There will be no additional refunds.
ONCE AN ORDER IS PLACED, CLIENT WILL BE IN AGREEMENT
TO THESE TERMS.
